David Lin has an educational background in engineering and law. His business areas include patents, copyrights, competition & antitrust, and data protection. He provides intellectual property services for well-known internet and high-tech enterprises such as ZTE, Xiaomi, Vivo, Meituan, Kingsoft, Kuaishou, and Niu Technologies. He also provides comprehensive intellectual property services for the Ministry of Transport, Peking University, Qilu Pharmaceutical, YRPG, Pingan Group and other national ministries and large commercial institutions.
In 2008, Lin represented the copyright infringement dispute of the “Struggle” TV series, which became a “red flag standard” in information network dissemination rights infringement cases. In 2009, he represented Tsinghua University in a well-known trademark and unfair competition case, which was recognised as a model IP case by the Beijing High People’s Court. In 2015, he represented Xiaomi in winning a case against Qihoo regarding jurisdiction objection, which was selected into the Annual Top 10 IP Innovative Cases by Beijing courts. In 2018, his case Xiaomi vs. Li’s right of reputation dispute was included in the top ten typical network reputation-related cases of the Primary People’s Court of Haidian District. In 2021, the right of information network dissemination dispute case between Youku and Baidu was selected as one of the 50 typical intellectual property cases of the Supreme People’s Court in 2020, the Top 10
Cases of Judicial Protection of IP Rights in Beijing courts, and the Top 10 Most Valuable IP Cases in China. The first reverse act preservation of Xinghao Plastic’s patent case was selected as one of the Top 10 Typical IP Cases on Technology of the Supreme People’s Court.
In 2022, the case of infringement of computer software copyright and trade secret dispute in which he represented LinkBroad and others against Amtt was selected as one of the Top 10 Cases involving Computer Software Copyright by the Beijing Intellectual Property Court. The case of unfair competition dispute in which he represented Kuaishou against Henan Piaodu was selected as one of the 10 Typical Cases of Judicial Protection of IP by the Henan High People’s Court in 2021. He represented Weibo in a case against the “Chao Ji Xing Fan Tuan” app for capturing and using celebrities’ data in Weibo, which was selected as one of the ten model cases of new types of disputes over unfair competition by the Haidian District People’s Court.
Lin was named Outstanding Young Lawyer as recommended by CLECSS in 2017. For five consecutive years since 2018, he has been named as one of “The A-List: China’s Elite 100 Lawyers” by China Business Law Journal, and as one of the top lawyers in Antitrust & Competition and IP Litigation by Legalband. Lin was recognised as one of the Top 50 Chinese Outstanding IP Lawyers by Zhichanli & IPRdaily. He was also among Legalband’s “Client Choice: Top 15 IP Versatile Practitioners” in 2020, “China Top 15 Lawyers – Automotive & New Energy” in 2021, and “Client Choice: Top 15 Compliance Lawyers” in 2022. In the same year, he was included in the Top 15 Legaltech Lawyers list by ACE. In 2023, he was named one of the “China Top 15 Lawyers – High-Tech & AI” by Legalband.
